Terms of Service

These terms apply when you use VividPlan, a service operated by Iskra Labs Pty Ltd. By creating an account, buying a plan or credit pack, or using VividPlan, you agree to these terms and our Privacy Policy. If you use VividPlan for an organisation, you confirm that you can agree on its behalf.

1. The service

VividPlan uses generative technology to create and edit architectural visualisations from drawings, floor plans, elevations, images, annotations, and instructions.

Generated images can contain mistakes or change details such as dimensions, geometry, structure, materials, lighting, or landscaping. They are concept visualisations, not construction drawings or architectural, engineering, planning, safety, or other professional advice. Check important details and use qualified professionals before relying on an image for approvals, costing, construction, or another purpose where accuracy matters.

2. Your content and generated images

You keep your rights in content you upload. You give us permission to host, copy, transmit, modify, and process it only as reasonably needed to provide, secure, support, and operate VividPlan, including through our hosting and AI providers.

As between you and us, we do not claim ownership of images generated specifically for you. Where we have any assignable rights in them, we assign those rights to you. AI-generated images may not be unique and the law may not recognise intellectual property rights in every output.

You must have permission to upload and use your content, including any drawings, photographs, personal information, confidential material, or third-party intellectual property it contains.

3. VividPlan intellectual property

VividPlan, including its software, interface, branding, templates, documentation, and underlying technology, is owned by Iskra Labs or its licensors. These terms give you permission to use the Service; they do not transfer ownership of VividPlan or permit you to copy, sell, or exploit those materials outside the Service.

4. Acceptable use

You must not use VividPlan to:

• break the law or infringe another person's rights;
• upload content you do not have permission to use;
• access another user's account or data;
• disrupt, overload, scrape, reverse engineer, or bypass the Service or its usage limits; or
• resell access to VividPlan without our written agreement.

5. Plans, payments, and cancellation

Prices, billing periods, features, and usage allowances are shown when you purchase. Paid subscriptions renew automatically until cancelled. You can cancel through Billing, and cancellation normally takes effect at the end of the current paid period.

Included monthly allowances reset and do not roll over. Purchased top-up credits do not expire while your account remains available, but are not transferable or redeemable for cash unless required by law. We may change prices for a future renewal after giving reasonable notice. See our Refund & Cancellation Policy.

6. Availability and suspension

We may update or change VividPlan over time. We do not promise that it will always be available, error-free, or that stored content will never be lost, so keep copies of important files and generated images.

We may suspend or close an account if fees are unpaid, these terms are materially breached, or use of the Service creates a security, legal, or abuse risk. Where practical, we will give notice and a reasonable opportunity to fix the issue.

7. Liability

Nothing in these terms excludes any guarantee, right, or remedy that cannot lawfully be excluded under applicable consumer law.

To the maximum extent permitted by law, VividPlan is provided "as is" and "as available". We do not guarantee that generated images will be accurate, unique, non-infringing, or suitable for a particular purpose.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or loss of profit, revenue, opportunity, goodwill, or data. Our total liability arising from VividPlan is limited to the greater of the fees you paid us in the 12 months before the claim and AUD $100. Where the law allows us to limit a remedy for a service, our liability is limited to supplying the service again or paying the reasonable cost of doing so.

8. Third-party claims

To the extent permitted by law, you are responsible for third-party claims and reasonable costs caused by content you upload, your infringement of another person's rights, or your unlawful use of VividPlan. This does not apply to the extent the claim was caused by our breach, negligence, or wilful misconduct.

9. Changes and governing law

We may update these terms and will post the new version and effective date here. We will give reasonable notice of material changes where practical. These terms are governed by the laws of Victoria, Australia, and its courts have non-exclusive jurisdiction.

10. General

We may correct pricing, billing, or product information that is clearly incorrect and may cancel or refund an affected transaction. Suggestions or feedback may be used to improve VividPlan without obligation to you. If part of these terms is unenforceable, the remaining terms continue to apply. These terms, together with the policies linked from them and any terms shown at purchase, form the agreement between you and VividPlan.
